The ACLU filed a lawsuit demanding access to documents related to the CBP policy of searching travelers’ laptop computers. The ACLU alleges that the laptop search policy violates travelers’ Fourth Amendment protection against unreasonable searches and seizures because laptops are searched without “individualized suspicion” of wrongdoing.
Last year, US Senator Russ Feingold (D-WI) criticized the CBP’s warrantless searches and seizures of travelers’ laptops and other digital devices at the US border, calling the searches an unacceptable invasion of privacy.
The US Supreme Court has held that reasonable suspicion is not necessary to conduct routine searches at the border, but Feingold said that searches of laptops and other digital devices are analogous to more invasive practices such as strip searches. In April of last year, the US Court of Appeals for the Ninth Circuit ruled that reasonable suspicion is not necessary for a warrantless search of a laptop or other digital device at the border due to inherent national security interests. The court rejected the argument that a laptop is like a human mind because of its ability to record ideas and emails, and held instead that a laptop is the same as closed containers such as purses and wallets.

The US Penitentiary in Leavensworth, Kansas appears to be the other leading candidate [Miami Herald Report] to house the detainees when the government closes Guantanamo.
Federal officials also said that terrorism trials for some inmates could be held at a new high-security courthouse in Newport News, VA [Washington Post report] if the Obama administration sends cases to federal courts.
Mich. residents are voicing their opposition to Gitmo inmates. Maybe it’s past time we all did because what this gov’t says and what it does are quite obviously two different things.
STANDISH, Mich. — Opponents dominated a public meeting Thursday on moving terrorism suspects from Guantanamo Bay to a prison in this small town, many accusing President Barack Obama of making Michigan a target for killer jihadists.
Nearly every speaker during the two-hour gathering, which opponents organized, denounced the idea — many arguing that the 229 detainees should remain where they are, despite Obama’s pledge to close the Guantanamo complex by 2010.
To add insult to injury, today we read that the US justice department is calling for some dozen prisoner abuse cases to be reopened because electric drills and mock executions were used by CIA agents to elicit information from terrorists.
What a world of weenies.
Maybe we need to think about the fact that these prisoners are ‘people’ who want any and all Americans DEAD. That’s you, me, every one. Black, white, brown, red, blue, green, purple, gay, straight, male, female, doesn’t matter. If you’re an American, they want you dead.
Who in their right mind could even consider letting so much as one of them step foot on American soil? Seems only one answer is plausible: Someone who hates Americans and our country equally as much as the terrorists hate us.
